Türkiye’de yapı üretiminde ve denetiminde yaşanan etik sorunlar

Türkiye’nin bir deprem ülkesi olması nedeniyle, gerçekleştirilen yapım işlerinin projelerine uygun yürütülmesi hayati önem arz etmektedir. Ülkemizde daha önce yaşanan depremlerde yıkılan yapılar incelendiğinde, yıkımların temel sebebinin deprem değil, yapıların uygunsuz üretimi olduğu belirlenmiştir. 4708 sayılı Yapı Denetimi Hakkında Kanun kapsamında “Yapı Denetim Kuruluşları” günümüzde Türkiye’nin bütün illerinde hizmet vermektedir. Ancak teorik olarak tatminkâr bir altyapıya sahip olan bu denetim sisteminin, uygulamada bir takım sorunları da beraberinde getirdiği ve suiistimallere açık olduğu bilinmektedir. Bu çalışmanın temel amacı, ülkemizde yapı üretiminde ve denetiminde karşılaşılan etik sorunları belirlemek ve yapı sahibi ile denetim kuruluşu arasındaki ilişkilerinin daha sağlıklı yürütülebilmesi için çözüm önerileri geliştirmektir. Bu kapsamda, Türkiye’nin 28 ilinde faaliyet göstermekte olan yapı denetim firmalarında aktif olarak çalışan toplam 200 teknik personele iki ana bölümden oluşan bir anket çalışması uygulanmıştır. Elde edilen veriler istatistiksel olarak değerlendirilmiş ve yapı denetiminde yaşanan etik sorunlar tarafsız bir bakış açısı ile gün yüzüne çıkarılmıştır. Sonuç olarak; yapı denetim firmaları, yapının taşıyıcı sisteminin uygun üretimini sağlamakta fakat yapı mimarisinin projeye uygun üretimiyle ilgili birtakım problemler az da olsa halen devam etmektedir. Bunun yanısıra, gerek kanuni prosedürlerle, gerekse yapının taşıyıcı sisteminin projeye uygunluğuyla alakalı problemler büyük ölçüde ortadan kalkmıştır.

The investigation of the structures destroyed in previous earthquakes has demonstrated that the main cause of the destructions is not the earthquake but the inappropriate production of the structures. Within the scope of the Law, nr. 4708, "building inspection institutions" are presently serving in all of Turkey's provinces. However, it is a well-known fact that although the current inspection system has a satisfactory infrastructure theoretically, it has several problems in practice and is open to abuse. The main objective of this work is to identify the ethical problems of the construction production and inspection in Turkey and to develop solutions to improve the relations between the building owner and the inspection institution. In this context, a survey study consisting of two main sections has been implemented to actively working 200 technical professionals of building inspection institutions in 28 provinces of Turkey. The obtained data were evaluated statistically and the ethical problems experienced in the building inspection were exposed with an objective point of view. As a result; building inspection institutions provide the proper production of the building's structural system but some problems with the project-oriented production of the building architecture still have not solely been solved. Besides, the problems related to the compliance of the structural system with the project as well as the legal procedures, have largely ceased to exist.
